Violations of the Work Environment Act: supervision and reactions
Last updated 2026-08-07
The Norwegian Labour Inspection Authority may carry out inspections both following a notification and unannounced. When breaches are found, the most common reactions are an order to rectify, coercive fines if the order is not followed, and in serious cases shutdown of operations or an infringement fine. Gross breaches may also have criminal consequences.
What happens during an inspection?
- The inspection is notified or arrives unannounced, depending on the background of the case.
- The enterprise must present documentation of systematic HSE work.
- Management, safety representatives and employees are interviewed.
- The authority sends a report with any notice of an order.
- The enterprise is given a deadline to rectify and document the rectification.
What documentation is most often requested?
- Documentation of completed HSE training for the top leader.
- Risk assessments, including psychosocial conditions.
- Action plans with a responsible person and deadline.
- Procedures for whistleblowing, conflict handling and sick leave follow-up.
- Minutes from the working environment committee and safety inspections.
What reactions may follow?
| Reaction | When it is used |
|---|---|
| Order to rectify | For a confirmed breach that can be corrected within a deadline. |
| Coercive fine | When the order is not complied with by the deadline. |
| Shutdown of operations | In case of imminent danger to life and health. |
| Infringement fine | For serious or repeated breaches. |
| Police report | For gross breaches, typically after a serious incident. |
What reduces the risk most?
That the documentation exists before the inspection, not after. Enterprises that log which leaders have trained on which situations and what was done afterwards stand significantly stronger than those that can only show a course certificate.
Frequently asked questions
Can individual leaders be held personally liable?
Yes, in serious cases. The Working Environment Act contains penal provisions targeting both the enterprise and persons who intentionally or negligently violate the Act.
What deadline is normally set for an order?
The deadline is set specifically based on severity and what must be corrected. It appears in the decision from the Labour Inspection Authority.
